Brazil: Judge from Minas Gerais is removed for allowing protesters camping

Brazilian Justice Inspector, Luís Felipe Salomão, determined on Monday (9) the removal of the duties of Judge Wauner Batista Ferreira Machado, from the third Court of the Municipal Public Treasury of Justice in Minas Gerais state.

The magistrate allowed the maintenance of camps opposed to Lula da Silva’s (PT) victory in Belo Horizonte. The decision was overturned on Saturday by Justice Alexandre de Moraes, of the Federal Supreme Court (STF).

“In view of the consolidation of the evidence presented here, pointing to the possible practice of serious disciplinary infractions by the magistrate, with the use of the position for the practice of acts that favor attacks on the Democratic State of Law, I DETERMINE, in an exceptional and preventive way, his immediate removal from the exercise of jurisdictional functions,” said Salomão.

“In the present case, based on the reports reported by the press, in addition to the content of the decision issued by the Federal Supreme Court, there is a need for an accurate analysis of the judicial statements issued by Judge Wauner Batista, considering the possibility that the pointed out repeated non-compliance with the decisions issued by the Federal Supreme Court go beyond the limits of jurisdictional action, revealing a disciplinary infraction”, said the magistrate.
