A South Sudan coup by constitutional means is under way, a United Nations rights commission told the General Assembly on Tuesday 27 October 2026. Commission chair Yasmin Sooka said elections set for 22 December are being used to dismantle the 2018 peace deal.

The warning went to the Third Committee in New York, which handles human rights at the UN, and Radio Tamazuj and Sudans Post reported it. The South Sudan coup warning matters to US readers because Washington funds aid there and watches a vote that could reignite war.

What the UN Said About the South Sudan Coup

The UN Commission on Human Rights in South Sudan is an independent panel of three experts created by the UN Human Rights Council. Its chair, Yasmin Sooka, told the Third Committee that elections had displaced a negotiated settlement.

She called it a constitutional coup carried out through legislative reforms, and the South Sudan coup warning was her central message. She said all authority is now concentrated in the President.

How Kiir Rebuilt the Government in September

On 22 September, according to the commission, Kiir dissolved the transitional government, the national parliament and the state legislatures. He removed First Vice-President Riek Machar and the other vice-presidents and appointed a caretaker administration answerable only to him.

The changes also freed the election from two transition conditions, a permanent constitution and a national population census. The earlier Rio Times report on the dissolution set out which offices went in that single order.

The 2018 Peace Deal and Why It Matters

The 2018 Revitalised Agreement on the Resolution of the Conflict in South Sudan ended a civil war that began in 2013. It shared power between Kiir’s party and rival groups, including the Sudan People’s Liberation Movement-in-Opposition led by Machar.

Sooka said elections cannot justify abandoning its safeguards, which include inclusive governance, free political competition, power-sharing and institutional oversight. She added that South Sudan will still need an inclusive settlement whether or not the vote takes place.

Machar on Trial and an Opposition Shut Out

Machar, a former rebel leader and Kiir’s main rival, remains detained and on trial. His party and other opposition groups remain excluded from the electoral process, according to the commission.

Kiir is expected to be the ruling party’s candidate in the December vote, a race the commission links to the South Sudan coup it describes. Commissioner Barney Afako said the current trajectory promotes exclusion and risks engendering disaffection and destruction.

Fighting in Upper Nile and Jonglei

The commission voiced alarm at aerial bombardments and ground offensives in Upper Nile and Jonglei states, two states in the north-east and east. It also cited attacks on civilian infrastructure, conflict-related sexual violence and the recruitment of children by armed groups.

It said tens of thousands of fighters remain outside a unified command and that impunity keeps the risk of renewed war high. Commissioner Carlos Castresana Fernandez said impunity is not only entrenched but rewarded, as people implicated in abuses hold senior posts.

What the Commission Wants Done

The commission urged the African Union, the regional bloc IGAD and the UN to activate a joint task force requested on 29 September. It also called for a Hybrid Court for South Sudan, a tribunal for serious crimes, and for resources for UN peacekeepers.

On the vote, it asked states to insist on safeguards such as civic freedoms, credible voter registration and the participation of refugees. Its three members are in New York from 26 to 30 October to meet governments and civil society.

What It Means for US Readers

The State Department rates South Sudan Level 4, Do Not Travel, and Washington is a major funder of humanitarian work there. A South Sudan coup dispute could bring new fighting, more refugees and pressure on oil exports, which run through a pipeline across Sudan.

Aid planners, investors and diplomats should treat the election as a political risk event whatever happens on the day. The South Sudan election guide covers entry rules and travel advice.

What Is Not Known

Neither Radio Tamazuj nor Sudans Post carried a reply from Kiir’s government to the South Sudan coup charge. It is open whether the 22 December vote will go ahead on schedule and whether Machar’s trial will end before it.

The commission did not name the sanctions or other consequences it wants member states to adopt. It is also unclear whether the African Union, IGAD and the UN will activate the joint task force.

Frequently Asked Questions

What did the UN commission say about South Sudan?

The UN rights commission told the General Assembly’s Third Committee on 27 October 2026 that the 2018 peace deal is being dismantled. Chair Yasmin Sooka called the changes a constitutional coup that concentrates all authority in the President.

What is a South Sudan coup by constitutional means?

It is a seizure of power carried out through laws and constitutional changes instead of force. The commission uses the term for Kiir’s legislative reforms, which it says dismantled the power-sharing settlement.

When is the South Sudan election?

The election is scheduled for Tuesday 22 December 2026, the date the commission said the world must look beyond. It urged action whether or not the vote is held.

What happened to Riek Machar?

Machar, who was First Vice-President under the 2018 deal, was removed on 22 September and remains detained and on trial. His party is excluded from the electoral process, the commission said.

Why should Americans care about South Sudan?

The US funds aid in South Sudan and rates it Level 4, Do Not Travel. Renewed war would raise refugee flows and threaten oil exports that depend on a pipeline through Sudan.
