A new regulatory framework for cryptocurrencies, approved in December 2022, is taking effect in Brazil.

Key features include the integration of fraud penalties into the Criminal Code and the establishment of norms for cryptocurrency exchanges.

The legislation, which the industry has received positively, expands existing financial laws and allows for more detailed regulation of cryptocurrency transactions.

Until now, the regulations had not been adapted to transactions with services related to virtual assets.

Experts believe this new framework could help prevent fraud, such as that of a former professional footballer who lost 6.3 million reais by investing in a cryptocurrency company.

While the legislation was passed late last year, it had 180 days to take effect – an adjustment period for active brokers in the market.

Now, market participants are required to comply with the established norms.

According to a recent decree issued by President Luiz Inácio Lula da Silva, the Central Bank of Brazil (BC) will be the supervisory authority for regulating and supervising this market.

Crypto assets are virtual, cryptographically secured assets with only digital records. They are not physical assets.

Transactions can be conducted between individuals or companies without needing a financial institution.

Crypto assets include cryptocurrencies such as bitcoin and other products such as tokens and stablecoins.

Meme coins, which have attracted attention due to significant increases in value, are also part of this market.

The new legislation creates a legal framework that is seen as the first step in regulating this market.

An important component is that fraud related to crypto assets will be treated as a crime.

Virtual asset providers, i.e. cryptocurrency exchanges, will only be able to operate in Brazil with prior authorization from the central bank.

The newly created legislation will encourage investment in the Brazilian cryptocurrency market.

According to a recent decree issued by President da Silva, the Central Bank will be responsible for regulating and authorizing crypto services and supervising players in the sector. It is noted that Brazil is moving towards formalization of the sector and that regulators are interested in dialogue to find the best ways to implement this innovation.

The new role of the Central Bank in approving licenses for companies in this sector should provide more security for people entering this market.

In particular, this should help prevent fraudulent practices as legislation tends to be stricter. This is one way to reduce fraudulent activity with cryptocurrencies.

With central bank regulation, one must now apply for a license to participate in the game.

This should make it harder for fraudsters to enter the market and allow for harsher penalties for these cases.
