Lawmaker Zambelli’s Legal Battle in Italy Revives Debate on Brazil’s Justice and Prison System

Carla Zambelli, a Brazilian congresswoman, now accepts she could be arrested and sent back to Brazil from Italy. She has shared a detailed legal document with Italian authorities, stating her innocence and arguing that her rights must be protected if she is extradited.

Zambelli draws a direct comparison to Henrique Pizzolato, a former Brazilian official who delayed his own extradition from Italy by highlighting poor prison conditions in Brazil.

Brazil’s Supreme Court sentenced Zambelli to ten years in prison for allegedly planning a cyberattack on the National Justice Council. The court claims she worked with a hacker to break into judicial systems and forge documents.

Zambelli’s defense says there is no proof she ordered or took part in the crime. Her lawyer, Fábio Pagnozzi, argues that the trial was unfair and that the main evidence came from a confessed hacker who gave inconsistent statements.

After her conviction, Zambelli left Brazil for Italy, where she has citizenship. She believed this would protect her from being sent back. However, Italian law allows extradition if there is an international treaty, except for political crimes.

Zambelli’s defense now admits that her Italian citizenship does not guarantee her safety from extradition. Her legal team’s main argument focuses on the conditions in Brazilian prisons.

They cite reports from Amnesty International and Human Rights Watch, which describe chronic overcrowding, violence, and poor sanitation. These same concerns led Italian courts to delay Pizzolato’s extradition in 2014.

Human Rights Concerns in Zambelli’s Extradition to Brazil

The courts said Brazil’s prisons were “dramatic” and that prisoners risked humiliation, torture, and violence. Only after Brazil promised better treatment did Italy agree to send Pizzolato back.

Zambelli’s defense says she is not asking for special treatment but wants her basic rights protected. They call for Brazil to follow international rules, like the United Nations’ Mandela Rules for prisoner treatment and recommendations from the Inter-American Commission on Human Rights.

They also suggest that, if extradited, Zambelli should serve her sentence in Italy or under international supervision. The defense stresses that Brazil has a legal duty to provide humane conditions for all prisoners.

If there is any sign Zambelli could face violence or poor treatment, international organizations could step in. Her lawyer argues that punishing her in a cruel way would break both Brazilian and international law.

Zambelli’s case highlights ongoing problems in Brazil’s justice and prison systems. It also raises questions about how countries handle extradition when human rights are at risk.

The outcome will affect not only Zambelli but also future cooperation between Brazil and other countries on legal matters.
