Appellate Judge Allows Former President Temer to Fly to England for Lecture

By · September 28, 2019 · 2 min read

RIO DE JANEIRO, BRAZIL – Judge Antonio Ivan Athié, of the Federal Appeals Court for the Second Region (TRF2), granted an injunction permitting former President Michel Temer to travel to England to speak at the Oxford Union between October 13th and 18th.

Judge Ivan Athié, when clearing Temer for the trip, wrote that on an initial examination, he checked the legal prerequisites for granting the injunction. “One can see the illegal embarrassment resulting from the judgment based on the rejection of the request for the defendant’s rights to travel abroad, in his personal opinion over the need for pre-trial detention, dismissed by the Superior Court of Justice”, he wrote.

The magistrate cited the tradition and prestige of the Oxford Union and determined that the 7th District Federal Criminal Court release Temer’s passport. The former president must return the document within five days after his return, along with the receipts of his trip.

In an unprecedented decision, Judge Marcelo Bretas, of the 7th District Federal Criminal Court of Rio, denied last week, the request to former President Temer. In the decision, Judge Bretas argued that the situation of Temer was not equal to a free person, because there were serious charges against him, arising from two criminal proceedings pending in lower courts.
