Maduro’s Wife Wants Out of a Brooklyn Jail. Reports That Cilia Flores Was Refused Are Wrong.

She has been held in a Brooklyn jail since American forces took her and her husband from a Caracas compound in January. Their trial is not listed until June 2027.

The wife of Venezuela’s deposed president wants to leave a Brooklyn jail and await trial at home. Whether Cilia Flores can is still open, which is not how it has been reported.

Her lawyers filed on Wednesday 9 September for home confinement inside the Manhattan federal court district. The Associated Press reported it the following day.

Since then the request has been described in several outlets as rejected. It has not been rejected, and the distinction is worth holding on to.

What the Filing Says

The argument is medical. Her attorneys, Mark Donnelly and Andres Sanchez, cite a longstanding mitral valve prolapse, a defect of one of the heart’s valves.

They say she has not received a monthly injection she requires since her arrest. They also say she has lost more than 25 pounds in custody.

Their formulation is that she deserves the opportunity to await trial on home confinement. It is a bail argument built on medical facts, which is how such motions are usually made.

The conditions offered are unusually heavy. They include armed surveillance around the clock and visitors approved by the court and by prosecutors.

The home would be under video monitoring. Telephone calls would be recorded.

The Miami Herald reported further elements in the filing. They include GPS monitoring, surrender of her passport, random searches and a court-approved custodian.

What Has Actually Been Decided

One thing, and it is not release. Judge Alvin Hellerstein ordered her medical records kept under seal on 10 September, finding her privacy interest outweighed public access.

El Diario NY, La Patilla and Efecto Cocuyo carried that order. It leaves the substantive request pending.

On the request itself, prosecutors had filed no written response. The Manhattan US attorney’s office declined to comment when the Associated Press asked.

Reporting that the prosecution rejected the request traces back to a social media post by a defence lawyer, relayed by CiberCuba. That is not a court filing and not a statement from the Department of Justice.

So the accurate description is that nobody has answered. The decision belongs to Hellerstein and he has not taken it.

How She Got to Brooklyn

American special forces raided a presidential compound in Caracas before dawn on 3 January 2026. Helicopters arrived at around two in the morning, Time reported.

They took Nicolás Maduro and Cilia Flores to the USS Iwo Jima and then flew them to New York. The Pentagon called the wider campaign Operation Absolute Resolve.

Venezuela‘s defence minister said a large part of Maduro’s security detail was killed. Cuba said 32 of its people died across the American raids, describing them as fighters on military missions.

Donald Trump said there were no American deaths. Time reported that some personnel were hit and expected to recover.

Delcy Rodríguez was sworn in before the National Assembly on 5 January. Most outlets called her interim president; Al Jazeera called her president.

The Charges

The case is numbered S4 11 Cr 205, brought against Nicolás Maduro Moros and five others. That S4 prefix marks it as the fourth superseding indictment.

Count one is narco-terrorism conspiracy. It names Maduro and two others, and it does not name his wife.

Cilia Flores is charged in counts two, three and four. Those are conspiracy to import cocaine, possession of machineguns and destructive devices, and conspiracy to possess them.

Both defendants pleaded not guilty in January. The underlying prosecution dates from March 2020 and concerns what American prosecutors call the Cartel de los Soles.

The Motion That Could End It

The more consequential filing is not about jail conditions. Both defendants moved on 2 September to dismiss on immunity grounds.

JURIST reported the motions the next day. Maduro’s counsel moved against the whole fourth superseding indictment, and his wife moved separately against counts two, three and four.

The argument has two limbs. Status-based immunity, as a head of state and his spouse, and conduct-based immunity for acts performed in office.

If that fails, trial is listed for 1 June 2027. Reuters reported the date on 22 July.

Why This Is Bigger Than a Bail Hearing

A sitting head of state was removed from his own capital by another country’s soldiers. He is now on trial in that country’s courts, and there is little precedent for it.

The UK House of Commons Library records the scholarly argument that the operation breached the United Nations Charter. The American attorney general framed it as law enforcement.

China condemned the operation and demanded the release of both Maduro and Cilia Flores. Russia demanded his return, and the European Union urged calm and adherence to the Charter.

The immunity motion is where that argument enters an American courtroom. A judge in Manhattan will rule on a question normally settled between governments.

The house arrest request runs on the same track. Whatever Hellerstein decides about a heart valve, he is also setting how an ordinary criminal docket treats two people taken by force.
