Brazil Electoral Court Orders Lula’s Campaign to Delete a Video Filmed at the Presidential Residence Within 24 Hours

Two separate electoral court cases landed on Brazil’s presidential race this week, and only one of them has produced an order so far.

The Brazil TSE Lula video order came on 22 September 2026, twelve days before Brazil’s first round. Kassio Nunes Marques, who leads the Superior Electoral Court (TSE), gave the campaign 24 hours to remove it.

What the Brazil TSE Lula video order requires

Nunes Marques granted the injunction on Tuesday 22 September 2026. He was acting on a complaint filed by Flávio Bolsonaro, the Liberal Party candidate for president.

Nunes Marques sits on Brazil’s Supreme Court and currently presides over the electoral court. The two roles are held together under Brazilian practice.

The order gives the campaign 24 hours to take the video off X, YouTube, Instagram and Facebook. It also bars the clip from free radio and television election advertising.

Lula and his running mate, Vice-President Geraldo Alckmin, have five days to present a defence. The court has not yet ruled on the merits of the complaint.

The measure is a liminar — the Brazilian term for a preliminary injunction. No case number for it has been made public.

Why the Alvorada setting mattered

The video was filmed at the Palácio da Alvorada, the president’s official residence in Brasília. It was posted on 3 September 2026.

Nunes Marques wrote that the setting, on a preliminary view, did not look neutral. He pointed to the national flag and the presidential standard behind Lula.

Article 19 of TSE Resolution 23.735 of 2024 lets an officeholder record at an official residence only in a neutral environment. That rule bars symbols, insignia and decoration tied to public power or the office held.

The judge also gave the Presidency, Secom and the GSI five days to explain the recording. Secom is the government communications office, and the GSI is the institutional security cabinet.

What Lula said in the clip

In the video Lula called the Banco Master scandal “the biggest robbery in Brazil’s history”. He named no politician.

He also said every person involved should be investigated, with no shielding for anyone. That was his own description of the case, not a finding by any court.

Banco Master is at the centre of a large bank fraud investigation in Brazil. The Supreme Court lifted secrecy over parts of that inquiry earlier this month.

The removal order does not decide anything about that investigation. It deals only with where and how the campaign video was made.

A separate case over Lula’s UN speech

Lula addressed the United Nations General Assembly in New York on 22 September 2026. He raised domestic themes including working hours, betting rules and national sovereignty.

That evening Flávio Bolsonaro and his running mate, Alfredo Gaspar, filed a second case at the TSE. They want Lula and Alckmin stopped from using the speech in campaign advertising.

They asked for a fine of R$50,000 (US$9,800) for each item or post that breaks such an order. Figures use 23 September 2026 rates, about 5.11 reais to the dollar.

The filing points to a 2022 TSE decision that stopped Jair Bolsonaro using his own UN speech in advertising. The request went to Nunes Marques and had not been decided by Wednesday.

How these cases differ from the August ruling

In August the full TSE overruled Nunes Marques and ordered a Flávio Bolsonaro video attacking Lula taken down. That case concerned opposition material, not the president’s own campaign.

The two new filings run the other way. Both were brought by the Bolsonaro campaign against Lula and Alckmin.

Only one of them has produced an order so far. The UN speech case is still just a request.

Both new cases went to Nunes Marques as the judge in charge. The full court can still review whatever he decides.

It is not confirmed that the video has come down from every platform. Lula’s campaign had not commented publicly by Wednesday 23 September 2026.

What the Presidency, Secom and the GSI will report about the filming is unknown. No date has been set for a decision on the UN speech request.

Both files sit with the same judge in the same court, and both remain open. Clearer answers should arrive in the days before the vote.
