On 8 January 2023, supporters of the defeated Jair Bolsonaro stormed Brazil’s Congress, presidential palace and Supreme Court in Brasília. More than two years later, the only armed-forces commander convicted over the alleged plot is the former navy chief, Admiral Almir Garnier Santos.

What the Court Found

In September 2025, the Supreme Court’s First Panel convicted Garnier and sentenced him to 24 years. It found him guilty of five crimes, including attempted coup d’état and membership of an armed criminal organization.

Prosecutors placed him, alongside Bolsonaro, in what they called the plot’s “crucial nucleus.” Bolsonaro was convicted in the same cases and sentenced to 27 years.

Much of the case rested on the plea-bargain testimony of Mauro Cid, Bolsonaro’s former aide. Cid told the court that Bolsonaro personally edited a draft decree meant to annul the 2022 result.

Bolsonaro’s defense spent the trial trying to discredit that testimony. Garnier, for his part, denies any wrongdoing.

The Detail the Wires Often Skip: The Forces Did Not Go Along

Brazil has three armed forces, each with its own commander. According to trial testimony, the army and air force chiefs resisted the plan; only Garnier, at the navy, did not.

Prosecutors argued that this refusal is a large part of why the coup never got off the ground. In their own account, the institution held even as one commander broke.

That distinction shapes the story. This was one service chief offering his force, not the armed forces as a whole moving against an elected government.

A Conviction From a Court on Trial Itself

What sets the Brazilian coup cases apart is that the court handing down the verdicts is itself under sustained challenge. Critics — the defense, much of the political right, and voices beyond it — say the prosecutions were shaped by a tribunal that had gathered extraordinary power.

Several threads feed that argument. The case was decided by a five-member panel rather than the full court.

Its rapporteur, Justice Alexandre de Moraes, was himself named among the alleged targets of the plot. Bolsonaro’s lawyers argued that this dual role was incompatible with impartiality.

The defense also alleged mishandling of evidence and questioned the reliability of Cid’s plea deal. And one justice, Luiz Fux, broke with his colleagues to vote for acquittal on the coup charges.

Supporters of the prosecutions reject all of this. They say the evidence was overwhelming, and that holding a former president and a service chief to account is exactly what an independent court is for.

An International Dispute, Not Just a Brazilian One

The controversy has spread well beyond Brasília. In 2025 the United States revoked visas for Justice Moraes and other Brazilian officials and moved to sanction them.

Washington has otherwise reserved such measures for figures like Venezuela‘s judges, an explicit and pointed comparison. It also tied trade tariffs to Bolsonaro’s treatment.

Brasília rejected the pressure as foreign interference. The opposition, in turn, has courted it, at one rally unfurling US flags and signs reading “SOS Trump.”

None of this settles whether the convictions are sound. It does mean the Garnier verdict lands inside a live argument, with one side seeing a democracy defending itself and the other a court expanding its power over political opponents.

The Defense, the Appeals, and What Comes Next

Garnier’s case is not over. In 2026 his lawyers filed a further appeal, a device used to reopen a conviction when a judge has dissented — their opening being Fux’s vote.

Separately, the admiral is contesting the loss of his military rank before the armed forces’ own court. Higher panels of the Supreme Court will decide whether the 24-year term stands.

The case has already sent a signal through the barracks that backing a coup now carries a personal price. For its critics, it sends a competing signal about how much power Brazil’s judges have gathered.
