What triggers a Colombia DIAN fine for an omitted declaration

Colombia’s National Tax and Customs Directorate, known as DIAN, imposes financial sanctions on any taxpayer who fails to file a declaration they were legally required to submit. The penalty structure is set out in Article 643 of the Colombian Tax Statute and varies significantly depending on the type of tax involved.

The most severe Colombia DIAN fine applies to the annual income tax return, or declaración de renta. Here the law is blunt: DIAN calculates the sanction at 20% of gross bank consignments or gross income for the period in question, or 20% of gross income from the last return filed, whichever figure is higher.

A statutory floor prevents the penalty from becoming trivial. The minimum fine is set at 10 UVT, Colombia’s tax value unit, which in 2026 translates to roughly COP 524,000 (about US$128).

That floor applies even if 20% of the relevant income would produce a smaller number.

How the penalty changes for VAT, withholding and foreign assets

Not every omitted declaration carries the same 20% hit. For a missed VAT return, known locally as the IVA or consumption tax declaration, DIAN generally applies a sanction of 10% of the relevant gross consignments or gross income.

Withholding tax returns follow a different formula. The penalty reaches 10% of cheques, costs or expenses recorded, or 100% of the total value shown on the last withholding return filed, whichever DIAN determines applies.

Taxpayers who hold assets outside Colombia face a separate obligation. Failing to submit the foreign asset declaration triggers a fine of 5% of the gross value of the assets reported or determined by the authority.

Some special taxes carry fixed-percentage sanctions under the same article of the Tax Statute.

Why the Colombia DIAN fine matters for expats and investors

Foreign nationals living in Colombia or holding assets there can easily stumble into the obligation to file. Tax residency rules are broad, and anyone who spends more than 183 days in the country during a 365-day window generally becomes a tax resident required to declare worldwide income.

An expat who assumes they only need to file in their home country may discover too late that DIAN expects a Colombian return as well. The 20% penalty on gross income, not net profit, can turn an oversight into a serious financial liability, especially when bank consignments are the basis for the calculation.

Investors with Colombian real estate, local company shares or bank accounts should also note that the foreign asset declaration is a separate filing. Missing it adds a 5% fine on top of any other sanctions, and DIAN has been steadily improving its cross-border data-sharing capabilities in recent years.

Collection actions and what happens after a missed deadline

The fine is not the end of the story. DIAN can initiate full collection proceedings once a declaration is flagged as omitted, which may include asset seizures, bank account freezes and reporting the taxpayer to credit bureaus.

Taxpayers who realise they missed a filing can sometimes reduce the damage by submitting the overdue declaration voluntarily before DIAN issues a formal sanction notice. The law provides for reduced penalties in cases of spontaneous compliance, though the specifics depend on the tax type and how much time has passed.

Interest also accrues on unpaid tax from the original due date. That means a taxpayer who omitted a return and owed tax faces both the 20% omission penalty and mora interest on the underlying liability, compounding the total cost.

Who must file an income tax return in Colombia

The obligation to file is not universal. DIAN sets annual thresholds based on gross income, bank consignments, credit card spending, purchases and net worth, measured in UVT.

For the 2025 tax year, filed in 2026, taxpayers whose gross income exceeded 1,400 UVT, roughly COP 73.4 million (about US$18,000), generally must declare.

Other triggers include holding bank deposits or financial investments above a certain level, making significant credit card charges or carrying a net worth above 4,500 UVT. Even salaried employees with a single employer can be required to file if their income crosses the threshold, making this a mass-market obligation rather than one limited to business owners.

What to watch next

DIAN has been modernising its enforcement toolkit, including the use of electronic invoicing data and bank reporting to identify non-filers automatically. The authority’s ability to detect omitted declarations is improving each year, shrinking the space for accidental or deliberate non-compliance.

Taxpayers with any doubt about their filing status should consult a Colombian tax professional before the annual deadlines arrive. The cost of advice is almost always lower than a 20% penalty calculated on gross income, and the peace of mind is worth considerably more.
