Brazil court overturns rulings against Bolsonaro’s son in embezzlement case
RIO DE JANEIRO, BRAZIL – By 4 votes to 1, Superior Court justices accepted the appeal of Flávio Bolsonaro’s defense and overturned all rulings and evidence collected by Judge Flávio Itabaiana of the Rio de Janeiro District Court.
At the time of the events, Flávio Bolsonaro was a state deputy in the Legislative Assembly of Rio de Janeiro (ALERJ), therefore the defense argues that since he had legal privileges, his case could not have been handled by a first instance judge.

The so-called “rachadinha” (splitting) occurs when legislators confiscate part of the salary received by their advisors, whom they appoint based on the assumption that they will take part of their salary, paid with public money.
The case of the president’s son dates back to 2020, when the Rio Prosecutor’s Office denounced him for alleged crimes of belonging to a criminal organization, embezzlement and money laundering.
The case is not annulled but is back to the starting point and will have to be investigated in another judicial area.
