The ongoing dispute between the Brazilian government and Eletrobras, Latin America’s largest power company, continues to simmer.

President Luiz Inácio Lula da Silva has rejected the repurchase of Eletronuclear shares, complicating efforts to increase state influence in the privatized company.

In addition, this conflict stems from the 2022 privatization of Eletrobras under former President Jair Bolsonaro’s administration.

The move reduced the government’s voting power to 10%, despite retaining a 42% stake in the company. Lula’s Workers’ Party opposed this privatization from the start.

He ruled out paying to reclaim the 35% stake in Eletronuclear given up during privatization. This stake is valued at R$ 21 billion ($3.68 billion).

Eletrobras’ Governance Dispute

Eletrobras has set conditions for allowing more government board members. They want the state to take over electronuclear shares and R$ 6 billion ($1.05 billion) in loans from state banks.

The government aims to increase its board representation from one to three members. The dispute has reached Brazil’s Supreme Court. In May 2023, Lula’s administration filed a lawsuit against Eletrobras.

They argued that voting power restrictions should only apply to stock bought after privatization. Justice Kassio Nunes Marques ordered negotiations between the parties.

This legal battle reflects broader tensions in Brazil’s energy policy. The government wants to balance private investment with state oversight. Eletrobras, now privately controlled, aims to maintain its independence from political influence.

The nuclear power issue adds complexity to the negotiations. Eletronuclear operates Brazil’s only nuclear plants, including the long-delayed Angra 3 project.
