Why Ecuador’s Jorge Glas Stays In Maximum Security As His Health Dispute Deepens

Jorge Glas once stood a step away from Ecuador’s presidency. Now his fight is about something more basic: who decides what “safe custody” and “adequate care” look like inside a maximum-security prison.

On December 28, 2025, judge Jean Daniel Valverde denied Glas’s habeas corpus petition. In simple terms, habeas corpus is a rapid court procedure meant to protect a person from illegal detention or serious abuses while in custody.

Valverde’s ruling keeps Glas in El Encuentro, a maximum-security prison in Santa Elena. The judge said the medical evidence did not prove an urgent condition requiring transfer to an outside hospital.

He also found no rights violation that would justify changing Glas’s detention conditions through this route. Glas has described “cruel and degrading” treatment and what he calls sustained psychological pressure.

His lawyers submitted a report listing 18 illnesses and said he takes 21 medications daily, including for severe depression, arguing he needs immediate outside hospitalization.

Glas Case Tests Diplomatic Protections and Courts

The Health Ministry countered with numbers meant to show close monitoring: 40 medical consultations in 47 days at El Encuentro, and 527 medical “attentions” from April 2024 through November 11, 2025. Later updates cited 567 total.

The story behind the story starts with an embassy door. Glas entered Mexico’s embassy in Quito in December 2023 and later received asylum.

Ecuadorian forces removed him in April 2024. Mexico broke relations and went to the International Court of Justice, arguing Ecuador violated diplomatic protections. Mexico has repeatedly demanded safe conduct for Glas.

Human-rights bodies remain engaged. The Inter-American Commission has kept precautionary measures in place and, in July 2025, asked the Inter-American Court for provisional protections, citing an extremely serious and urgent risk.

Glas is serving sentences tied to Odebrecht-linked bribery and the “Sobornos” network. In 2025, a court added a 13-year term over misuse of 2016 earthquake reconstruction funds, plus a fine, a lifetime public-office ban, and a prison horizon into the 2040s.
