Silenced Evidence: Bolsonaro Defense Claims Prosecution Conceals Key Facts

Jair Bolsonaro’s legal team has formally contested the charges against him related to an alleged coup attempt, highlighting what they claim are multiple procedural irregularities in the prosecution’s case.

The defense submitted their arguments to the Supreme Federal Court (STF) in response to accusations that the former Brazilian president orchestrated a plot to remain in power after his 2022 electoral defeat to Luiz Inácio Lula da Silva.

According to available information, Bolsonaro’s defense team has characterized the prosecutor’s accusations as “vague” and “inept”, expressing both “dismay and indignation” at the charges.

They maintain that the former president “has never agreed to any movement aimed at deconstructing the democratic rule of law or the institutions that underpin it”.

Bolsonaro’s Legal Struggles and Defense Strategy

In his public statements, Bolsonaro has framed the accusations as politically motivated, claiming they stem from “an authoritarian regime that creates internal enemies to legitimize persecution, censorship, and arbitrary detentions”.

He has drawn parallels between his situation and those of opposition figures in other Latin American countries governed by leftist leaders. The former president faces serious charges including attempting a coup d’état, violent abolition of the democratic rule of law, and participating in an armed criminal organization.

The indictment alleges that Bolsonaro led a complex conspiracy codenamed “Green and Yellow Dagger” that included shocking elements such as plans to assassinate then president-elect Lula, his vice president Geraldo Alckmin, and Supreme Court Justice Alexandre de Moraes.

Bolsonaro’s defense team has expressed confidence they can win the case. The Supreme Court of Brazil is expected to review the charges between late March and early April 2025, with Justice Alexandre de Moraes, who is overseeing the case, having granted the defendants 15 days to present their defense.

If convicted, Bolsonaro could face between 38 and 43 years in prison, effectively ending his political career though his legal team continues to maintain his innocence.
