Brazilian Court Machinery Targets Bolsonaro as Justices Reject Recusal Appeals

The Supreme Federal Court of Brazil predictably rejected appeals from former President Jair Bolsonaro and two military generals this week. Justices Alexandre de Moraes, Flávio Dino, and Cristiano Zanin will remain on the bench despite their clear political entanglements with the case.

Supreme Court President Luís Roberto Barroso orchestrated the majority opinion with seven justices falling in line. The targeted justices conveniently abstained from votes about their own exclusion while supporting each other’s continued involvement.

Bolsonaro’s legal team pointed to obvious conflicts of interest. Justice Dino served as Lula’s Justice Minister during the January riots and previously filed personal complaints against Bolsonaro. Justice Zanin worked as President Lula‘s personal lawyer before his swift appointment to the court.

Most troubling, Justice Moraes serves as both investigator, prosecutor, and judge in the case. The very justice who controls the investigation also decides its outcome, a model eerily reminiscent of Venezuela’s judicial approach.

The court discarded evidence of bias with a simple wave of Barroso’s pen. “Generic allegations without concrete proof cannot characterize impediment,” his ruling stated, effectively establishing an impossible standard for recusal.

This selective judicial process follows a familiar pattern since Lula took power. The same court that swiftly freed Lula from corruption charges now pursues his political opponents with unprecedented zeal.

Bolsonaro Faces Accusations and Legal Proceedings

Federal Police, under direction from Moraes, accused Bolsonaro and 36 others of plotting against democracy. The timing conveniently undermines Bolsonaro’s potential 2026 presidential run against Lula.

The court confiscated Bolsonaro‘s passport months ago. Justice Moraes rejected his request to attend Donald Trump’s inauguration while government-aligned figures travel freely.

The First Panel will begin formal proceedings against Bolsonaro on March 25. This handpicked group of justices holds tremendous power over Brazil’s political landscape. A conviction would eliminate Lula’s strongest political rival through judicial means rather than electoral competition.

Brazil’s institutions increasingly mirror those of its northern neighbor, where courts serve as extensions of ruling party interests rather than independent arbiters of justice.
