The Banco Master liquidator has sued in a US court to take back three luxury homes in Aspen, Colorado, and Miami, Florida. It says the properties were bought with money diverted from the failed Brazilian bank. For US readers, the case puts American homes, Delaware companies and US bank accounts at the centre of a Brazilian fraud case.

The complaint was filed on Wednesday 7 October in the US Bankruptcy Court for the Southern District of Florida, in Fort Lauderdale.

The defendants are Clear River Properties LLC and Goldbeach Properties LLC, both registered in Delaware. Daniel Vorcaro, Banco Master’s former president and controlling shareholder, is not named as a defendant.

The São Paulo broadcaster Jovem Pan reported late on Sunday 11 October that summonses went out on Thursday 8 October. The two companies have until Monday 9 November to respond, it said.

Who Is Suing and Why

The plaintiff is EFB Regimes Especiais de Empresas, the firm Brazil’s central bank appointed as extrajudicial liquidator. Its job is to recover assets for the bank’s creditors. Eduardo Felix Bianchini represents it.

The central bank ordered Banco Master and three sister firms into liquidation on Tuesday 18 November 2025. The liquidator then asked the Florida court to recognise the Brazilian process under Chapter 15 of the US Bankruptcy Code.

Chapter 15 lets a foreign insolvency officer act in the United States. Judge Scott M. Grossman granted that recognition on Thursday 8 January 2026. The order gave the liquidator power to administer and realise the banks’ assets on US soil.

According to the complaint, Vorcaro was arrested on suspicion of a R$12.2 billion (about US$2.4 billion) fraud on Monday 17 November 2025. He was released on 28 November with an ankle monitor. Brazil’s Supreme Court ordered him back into custody on Wednesday 4 March 2026.

What the Liquidator Alleges

The complaint says money left Banco Master through Brazilian investment funds and offshore companies. It says much of it reached a Bahamas fund, the Mosaic Short Duration Fund.

From April 2024 through October 2025, that fund received more than US$430 million diverted from the bank, the liquidator alleges.

On 9 April 2024 the fund signed a loan agreement for up to US$350 million with Mosaic Group LLC. The liquidator says that company had no apparent business beyond the fund’s money, and owns both defendants.

On Thursday 11 April 2024, Clear River bought 600 Owl Creek Ranch Road in Aspen for US$77 million. Goldbeach bought a bayfront estate at 4425-4445 Sabal Palm Road in Miami for US$85.2 million on Tuesday 7 January 2025.

A month later, on Monday 10 February 2025, Goldbeach bought 4430 Sabal Palm Road across the street for US$6.9 million. All three deals closed in cash, without mortgage financing, the filing says.

The complaint says Vorcaro held long-term leases giving him exclusive use of the homes. It alleges he did not make the required lease payments.

It also says company papers were changed to list Vorcaro’s family trust, the Fortress Legacy Trust, in place of Vorcaro himself. The liquidator calls this concealment.

The money kept flowing after the bank failed, the filing alleges. Transfers listed in it add up to US$37.5 million to the two companies between December 2025 and March 2026.

The Banco Master liquidator asks the court to hold the homes in trust for the bank, or to place a lien on them. Alternatively, it wants at least US$77 million from Clear River and US$92.5 million from Goldbeach. It also seeks a receiver and a bar on selling the homes.

Some claims rest on Brazilian law, including clawback rules in the country’s bankruptcy statute. Brazilian media put the total value of the homes at R$843 million (about US$169 million).

A Second Case Over Jet Money

Jovem Pan reported a second adversary case, No. 26-01351, filed on Friday 2 October. It names PS-MGG Administração de Bem Próprio S.A. and Insured Aircraft Title Services, a US aircraft title firm.

The broadcaster said the dispute concerns about US$42 million in proceeds from a jet sale. It said both firms were summoned on Monday 5 October and must answer by Wednesday 4 November.

The Rio Times has not seen that filing, and the claim has not been independently confirmed. Jovem Pan itself said the court records do not show the aircraft was seized or any money recovered.

The US cases run alongside a Bahamas proceeding. For background, see Bahamas Sets 8 October Hearing on Banco Master Fund.

What It Means for You

For investors, the case shows Brazilian liquidators using US courts to follow money. Delaware shells and cash purchases did not keep these homes out of reach.

Anyone who did business with Vorcaro-linked companies in the US may receive subpoenas or claims. The complaint names large US banks as routes for the money, but it does not accuse them of wrongdoing.

For Brazil, recovered assets would go towards creditors of the bank. The process is slow, though, and a US judgment can take years. Earlier freezes in Brazil already reached artworks; see Brazil’s Banco Master Asset Freeze Reaches a Picasso and Two Basquiats.

What Is Not Known

It is not known whether the two companies will contest the suit, or who will represent them. Vorcaro’s lawyers have not commented publicly on this case.

The court has not frozen the homes or ruled on any claim. It is also unclear what the Bahamas court decided at its hearing on 8 October.

In Brazil, the criminal case has stalled during the election; see Brazil’s Supreme Court Freezes Banco Master Cases Until After the Election. Vorcaro has not been convicted and is presumed innocent.
