Venezuela’s Amnesty Law Frees Hundreds but Not All

Venezuela’s National Assembly approved an amnesty law by unanimous vote on Thursday, and Acting President Delcy Rodríguez signed it into law within hours. It was the most consequential — and most contested — legislation of the post-Maduro era.

The law covers political crimes committed during 13 periods of crisis stretching back to 1999, including the 2002 coup against Hugo Chávez, opposition protests in 2014 and 2017, and the crackdown after the disputed 2024 election. Those who fled the country can have a lawyer request amnesty on their behalf, a concession won by opposition lawmakers after two weeks of negotiations.

Who stays behind bars

The law explicitly excludes anyone accused of promoting armed action against Venezuela‘s sovereignty — a clause broad enough to potentially cover Machado, whom the ruling party accuses of encouraging the U.S. military intervention that ousted Maduro on January 3. Around 174 military prisoners charged with rebellion are also excluded.

Homicide, drug trafficking, corruption, and grave human rights violations fall outside the amnesty. Courts have 15 days to process each request.

Freedom with caveats

The legislation arrives after 444 political prisoners have been released since Maduro‘s capture. But Foro Penal estimates more than 600 remain in custody. Among those freed Thursday was Juan Pablo Guanipa, a former National Assembly vice president and Machado ally imprisoned for nearly nine months.

Guanipa’s case illustrates the fragility of the process. He was released earlier this month, then re-arrested hours later for allegedly calling supporters to the streets. He spent weeks under house arrest before being freed again after the law passed.

Forgiveness or justice?

The deepest fault line runs through the law’s philosophy. The ruling Chavista bloc frames the measure as an act of forgiveness. Families and human rights defenders argue it should acknowledge that many detainees were arbitrarily imprisoned and never committed crimes at all. They want reparations and guarantees of non-repetition — neither of which appears in the text.

Foro Penal vice president Gonzalo Himiob called the law an important but incomplete step, writing on social media that true freedom would come only when the entire apparatus of political repression is dismantled. For the families still holding vigil outside prisons across Venezuela, the law offers a door — but not yet an open one.
