Harassment by GOL airline: São Paulo judge overturns dismissal of employee who did not get vaccinated against Covid

Since last year, GOL has been the target of serious accusations of harassment, abuse, and aggression against employees who refused to be inoculated with experimental products.

A sentence handed down by the labor judge Jefferson do Amaral Genta, from the 1st VT/Praia Grande-SP, reversed the dismissal for just cause that GOL Linhas Aéreas gave to a telecommuter.

Even working in his home office, the man was pressured to get the experimental shot and fired after refusing to do so.

In a deposition, the man explained that he only came to the company’s headquarters when there was a problem with the equipment he was using and said that he only came to GOL once to change his headset.

GOL claimed that the employee disregarded the internal policy of Covid-19 vaccination but confirmed that the man worked remotely.

In the decision, even acknowledging the injustice against the employee, the judge said that vaccination is an effective means of preventing the contagion of the disease, which contradicts statements from the manufacturers of the “immunizers” themselves, who have already publicly acknowledged the ineffectiveness of the so-called “anti-covid vaccines.”

“However, it is certain that in the case of the plaintiff, who did not physically work on its premises, the company could not have used the vaccine requirement to justify the termination for just cause,” said the judge in the decision.

In addition to paying prior notice, proportional 13th salary, proportional vacation + 1/3, and a fine of 40% of FGTS, GOL must also pay compensation of R$3,000 for moral damages.

OTHER CASES

The company has been creating controversy since last year when it decided to force the vaccination of employees, even those who submitted medical reports waiving the application of the vaccine under risk of health complications.

The company has been the target of serious complaints of harassment, abuse, and assault of employees.

Most of the victims of the company’s coercion are women who have led movements for better wages and working conditions within the company and say they have submitted a medical report attesting to the impossibility of taking the vaccine.

One of the complainants even reported a case of aggression against a colleague who refused to take the vaccine because she had a chronic illness.

Even after being forced to get vaccinated, the aggression did not stop, and the employee requested leave from work for psychiatric treatment.
