Brazil: Justice Lewandowski annuls contract between Federal Government and Pernambuco over Noronha

The Justice of the Federal Supreme Court (STF), Ricardo Lewandowski, annulled the contract for the assignment of use under special conditions of the island of Fernando de Noronha, concluded between the Union and the State of Pernambuco in 2002.

According to him, the annulment of the current assignment agreement is necessary for ratifying a new agreement to be approved between the Union and Pernambuco for the integrated management of the conservation units on the archipelago.

Lewandowski also states that the nullity stems from the fact that the contract was entered into without the authorization of the Legislative Branch.

Last Friday, Lula’s government signed an agreement with the state of Pernambuco to try to create shared management of the Fernando de Noronha archipelago.

The new agreement goes against former president Jair Bolsonaro‘s attempt to federalize Noronha.

In March 2022, the Union Attorney General (AGU) filed a lawsuit with the STF so that Noronha would not be part of the state of Pernambuco.

As the issue involves a federative conflict of great repercussion for the Union, the state, and private individuals, Lewandowski requested the president of the STF, Justice Rosa Weber, to convene an extraordinary session of the Virtual Plenary for deliberation on the issue.
