Digital security will be a priority in court, says Brazil’s future Minister of Justice

Brazil’s future Minister of Justice, Flávio Dino (PSB), said on Monday (20 Dec. 2022) that his priority at the head of the portfolio will be digital security. He stated that the PF (Federal Police) will create a board specialized in cyber crimes.

“A sovereign country cannot be hijacked by private corporations, whatever they may be, because that is dangerous in every sense,” he said in an interview with TV Cultura’s “Roda Viva” program.

Dino stated that the overthrow of the budget rapporteur’s amendments, which part of the media calls a “secret budget”, by the STF (Federal Supreme Court) meant a “reframing of the balance between the Powers”.

When asked about the two nominations that the elected president, Luiz Inácio Lula da Silva (PT), will make to the Court, the future minister, who is a former federal judge, said that the PT should prioritize someone who has “the courage to be countermajoritarian”.

“We need to distinguish, very clearly, the role of the political function from the technical function. The politician has to be here, the politician has to be in the street, the politician has to be in the square and the politician has the duty to exercise a function of representing the majority. The judge, the magistrate, can do all that. But he has a fundamental difference in relation to the politician: this magistrate has to have the courage to be countermajoritarian to protect the Constitution”, he declared.

Without mentioning the former Lava Jato judge and elected senator, Sergio Moro (União Brasil-PR), Dino said there is a “karmic case”, and a well-known one, of when the magistrate “is enchanted by the spotlight and uses the toga to make policy”.

Presenter Vera Magalhães recalled that Justice Rosa Weber, president of the STF, is one of those who retire during Lula da Silva’s term and questioned whether the future president will nominate another woman for the vacancy.

“It is not something decreed, but it is something natural that occurs [the appointment of a woman to the Supreme Court],” he replied.
