Argentine Justice orders the Army to hand over land to Mapuche community near Bariloche

RIO DE JANEIRO, BRAZIL – The case was initiated in December 2020, when the Mapuche community Millalonco Ranquehue filed an injunction against the national government to implement the “definitive and unconditional recognition” of the community property, register it in the public records, and issue the title deed.

Last February, a decision of the Federal Court of San Carlos de Bariloche, in charge of María Silvina Domínguez, upheld the claim and ordered the Executive Power to “immediately” award the property to the Mapuche community within 60 days.

The Argentine Army appealed this ruling, but the Court of Appeals of General Roca rejected it last April 28, arguing that the appeal was filed out of time.

In this way, the first instance ruling that obliges the State to hand over some 180 hectares, according to official sources, belonging to the Army, located 12 kilometers from the city of Bariloche, where the Argentine Army’s Military Mountain School “Teniente General Juan Domingo Perón” is located, became final.

According to official sources, the Argentine Army plans to appeal to the Supreme Court.
