Why Colombia’s Tax Reform Is Probably Dead — and What It Means for Foreign Residents

Two days after Colombia’s president-elect lost the Senate presidency, he won his first real vote in Congress — and the swing tells foreign residents something reassuring: the tax reform that would have reached their worldwide assets now looks almost certainly dead.

What the Senate did

After a four-hour debate on July 22, the Senate voted 55 to 32, with 16 not voting, to temporarily relocate Congress to the department of Cauca for the August 7 swearing-in. It was the first congressional win for president-elect Abelardo de la Espriella.

The approved text names Cauca but does not specify a military garrison, which the president-elect had wanted; it neither confirms nor forbids one. The Cámara de Representantes votes on the same question on July 28, and is expected to approve.

Why it reverses the July 20 story

Only two days earlier, the president-elect had lost the Senate presidency to a candidate his coalition did not control, a defeat read as a sign he could not command the chamber. This vote points the other way.

By assembling 55 votes, he showed his bloc can build a working majority when it matters. The July 20 loss, one analysis concluded, now looks more symbolic than practical.

The arithmetic that matters for taxes

The same vote count carries a second message. If the incoming government can reach a majority, the outgoing government’s opposition cannot: the Pacto Histórico and its allies top out around 40 senators, well short of the 52 needed to pass ordinary laws.

That is the number that decides the fate of the six reforms the outgoing government filed on July 21, including the tax reform that would cut the wealth-tax threshold and reach resident foreigners’ worldwide assets.

Why the wealth-tax reform is probably dead

The wealth-tax reform would lower the threshold to about US$620,000 of net worth, pulling in far more residents, including foreigners taxed on worldwide assets. But it lands with about two weeks left in the outgoing term and no majority to carry it.

One reading of the seat count is that the reform is now “almost impossible” to approve this term. It essentially reproduces a financing law Congress already rejected, and a former tax-agency official had already said it would likely be withdrawn.

What this means for residents

For foreign residents worried about the lower wealth-tax floor, the practical signal is reassuring: the measure is very unlikely to become law before the handover. Nothing changes before August 7 in any case.
