Alexandre de Moraes removes Ibaneis Rocha from the Federal District government

Justice Alexandre de Moraes of the Brazilian Supreme Federal Court (STF) ordered the removal, for 90 days, of Ibaneis Rocha (MDB) from the position of governor of the Federal District, due to acts of vandalism this Sunday (8) that destroyed the Planalto Palace, the National Congress and the Federal Supreme Court (STF). In the decision, he pointed out “intentionally omissive conduct” of the representative.

“Not only did he make public statements defending a false ‘free political demonstration in Brasilia’ – even though all the networks knew that attacks on the Institutions and their members would be carried out – but he also ignored all the appeals from the authorities to carry out a similar security plan those carried out in the last two years on September 7, in particular, with the prohibition of terrorist criminals entering the esplanade of the Ministries; having released wide access”, wrote the Justice.

He also noted that the Organic Law of the DF points out as crimes of responsibility of the governor and his secretaries acts that attempt against the existence of the Union and the Federal District, the free exercise of the Executive and Legislative Powers or other constituted authorities, and the internal security of the country and the Federal District.

Moraes listed four facts that, according to him, constitute “extremely strong evidence” of “serious failures in the performance of public security agencies in the Federal District”.

Among them, the escort of military police to demonstrators to Praça dos Três Poderes, the lack of resistance on the part of the Military Police to the invasions, including the abandonment of posts by some police officers; and the fact that agents filmed, jokingly and for personal entertainment, “the terrorist and criminal acts”. He also pointed out that the DF Security Secretary, Anderson Torres, was removed from office while invasions were still taking place.

In another part of the decision, Moraes pointed out “omission and connivance” not only by Ibaneis, but also by the now former DF Public Security Secretary Anderson Torres, “with criminals who previously announced that they would commit violent acts against the constituted powers”.

Torres’ responsibility, noted the Justice, is being investigated in a specific procedure – earlier, the Advocacy General of the Union (AGU) asked for the arrest of the delegate, who before resuming the Security Secretariat, was Minister of Justice of the government of the former president Jair Bolsonaro. In the decision, Moraes wrote that there was “negligence” on his part, “with any planning that would guarantee security and order in the Federal District”.

MORAES DETERMINES THE ARREST OF PARTICIPANTS OF ACTS IN BARRACKS

In the decision, Moraes also determined the dissolution, within 24 hours, of camps across the country, near Army barracks, composed of protesters opposed to the election and inauguration of President Luiz Inácio Lula da Silva. The participants, according to the Justice’s order, should be arrested in flagrante delicto.

They will be framed in the crimes of terrorist acts, including preparatory ones; criminal association; violent abolition of the democratic rule of law, coup d’état, threat, persecution and incitement to crime.

The execution of arrests will be the responsibility of the Military Police, with support from the National Security Force and the Federal Police, if necessary. Military commanders of the barracks and municipal authorities must support the measure, under penalty of personal liability, in accordance with the Justice’s decision.

In the same 24 hours, the highways blocked by protesters and drivers must be vacated with the support of the PMs, PF and Federal Highway Police. Moraes also ordered the seizure of all the buses that took demonstrators to the Federal District.

In the decision itself, he listed license plates for 87 vehicles, whose owners must be identified and heard within 48 hours, to inform passengers and transport contractors.

The Justice also prohibited buses and trucks carrying demonstrators from entering the Federal District until January 31. PRF and the PF, he ordered, should arrange for the blockade, the immediate seizure of the bus and take testimony from all passengers.

It will also be up to the PF to obtain security footage of the Federal District for facial identification of invaders of public buildings and to obtain, in hotels, a list of guests who have arrived in the federal capital since last Thursday (5), to identify any participants in the act.

Finally, the Justice also determined that Facebook, Instagram, Tik Tok and Twitter block 17 accounts and user profiles that, according to him, may have encouraged vandalism.
