Nine people in Washington hold extraordinary power. The justices of the U.S. Supreme Court serve for life, answer to no one, and can strike down any law.

Their decisions shape American life on everything from abortion to presidential authority, and often influence legal thinking worldwide.

Now this institution, already the most secretive branch of American government, has gone darker. In November 2024, two weeks after Donald Trump won reelection, Chief Justice John Roberts gathered staff and asked them to sign nondisclosure agreements.

Not informal pledges, but legal contracts threatening lawsuits against anyone who reveals the court’s inner workings.

What prompted this? A pattern of embarrassing leaks.

In 2022, someone disclosed a draft ruling overturning abortion rights before it was announced, sparking nationwide protests. An investigation questioning 97 employees found nothing. The justices themselves were never asked to testify under oath.

Then in September 2024, The New York Times published Roberts’ private memos showing he had pushed colleagues to grant Trump immunity from prosecution, previewing exactly how the court would rule months later.

Conservatives argue secrecy protects judicial independence. Judges must deliberate freely without public pressure, they say, and the agreements simply formalize longstanding expectations.

Critics counter that secrecy enabled something troubling: investigations revealed Justice Clarence Thomas accepted over $4.75 million in undisclosed gifts from wealthy donors, including private jet travel and a relative’s school tuition.

Justice Samuel Alito took an unreported luxury fishing trip funded by a billionaire whose company later had cases before him.

Public confidence collapsed. Trust fell from 75% in 2005 to 44% today. Only 24% of Democrats trust the court, versus 71% of Republicans.

The court adopted an ethics code in 2023 but with no enforcement mechanism. Now instead of transparency, it demands silence.

For democracies everywhere watching institutional trust erode, America’s highest court offers a cautionary study: when legitimacy falters, do you open the doors or bolt them shut?
