Key Facts

  • —What is happening Puerto Rico’s Justice Department confirmed on Tuesday, 20 October 2026 a preliminary investigation of Familia Secretary Suzanne Roig Fuertes over alleged pressure to sign contracts, and two prosecutors have 90 days.
  • —Why it matters A sitting cabinet secretary who runs federally funded family programs is under a formal criminal review, and the result decides whether an independent special prosecutor takes over.
  • —The numbers The disputed Star Academy education deal was worth US$38.5 million of federal TANF money, an alleged second proposal was about US$300,000, and the review window is 90 days, extendable by up to 90 more.
  • —Who is who Roig leads the Departamento de la Familia and denies wrongdoing, Lourdes Gómez Torres runs Justice, Thomas Rivera Schatz presides over the Senate, and ex administrator Blanca Medina Díaz made the allegations.
  • —What to watch Watch for a Justice report to the independent prosecutor Panel, due about 18 January 2027 if the 90 days run from 20 October, and for any request for an extension.
  • —What it means for you The money is a US federal block grant, so US taxpayers and any federal grant overseers have a stake, but nothing so far shows a charge, a federal case or Roig leaving office.

Justice has started a 90 day review. It decides whether Puerto Rico’s Family Secretary faces an independent prosecutor.

The Puerto Rico Familia secretary probe became formal on Tuesday, 20 October 2026, when Justice Secretary Lourdes Gómez Torres confirmed it. It covers contracting steps led by Family Secretary Suzanne Roig Fuertes, whose agency runs federally funded aid programs.

Two prosecutors have 90 days to gather documents and interview witnesses, then Justice must advise on a special prosecutor. Gómez Torres stressed that the probe does not mean a crime was committed.

How a Preliminary Investigation Works in Puerto Rico

The process follows Act 2 of 1988, which created the Panel on the Independent Special Prosecutor, known by its Spanish initials PFEI. The Panel is a separate body that can appoint a special prosecutor when Justice itself might face a conflict of interest.

Cabinet secretaries are covered officials, so Justice reviews sworn information that may show a crime by one of them. Former administrator Blanca Medina Díaz gave a sworn statement, and Senate President Thomas Rivera Schatz sent Justice a referral.

Under Act 2, as amended in 2012, Justice has 15 working days to decide whether a preliminary investigation is warranted. If it opens one, it has 90 days to finish.

Justice can ask the Panel for up to 90 more days when a case is complex, and the Panel may grant it. If Justice lets the deadline pass, it loses jurisdiction and must hand the whole file to the Panel within 10 days.

When the review ends, Justice sends the Panel a detailed report with a recommendation on whether a special prosecutor is needed. The Panel, not Justice, makes the final call.

Where the Puerto Rico Familia Secretary Probe Goes Next

Justice said it received the referral on Wednesday, 30 September 2026, with a deadline of 22 October to decide on an investigation. It announced the decision two days early, on Tuesday, 20 October.

Gómez Torres said two prosecutors were assigned, collected documents and interviewed several people during the initial evaluation. She added that the probe will also cover other related allegations and that more witnesses will be interviewed.

Prosecutor Ernesto Cabrera, who directs the Public Integrity Division, said Medina Díaz was summoned as a witness before the announcement. He said no one else was summoned that day and did not say whether others will be.

The announcement did not state the day the 90 days begin. Counted from 20 October, they end on Monday, 18 January 2027, and a full extension runs to about mid April 2027.

Possible Outcomes for Secretary Roig

The first outcome is that Justice recommends a special prosecutor and the Panel agrees. That prosecutor would investigate and could file criminal charges, which is a separate step from this review.

The second outcome is that Justice recommends against a special prosecutor, but the Panel can still appoint one. The law requires Justice to send its file to the Panel even when it finds no cause.

The third outcome is that Justice closes the matter and the Panel accepts that view. In May 2026 Justice declined to probe Roig over an unrelated perjury referral, and the Panel said it could look again.

A fourth path is a delay, if Justice asks for and wins an extension. None of these outcomes removes Roig from her post, and no source checked says Governor Jenniffer González Colón plans to do so.

The Contract Behind the Allegations

Medina Díaz led the Family Socioeconomic Development Administration (ADSEF) for about six months. She says she refused to sign a US$38.5 million contract that she called illegal.

The deal involved NOLA Education LLC and a school program called Star Academy, paid from the federal TANF aid grant. She also alleges, as El Nuevo Día reports, pressure over a separate proposal of about US$300,000 for training and technology.

The governor’s office confirmed her dismissal on Tuesday, 29 September, and cited insubordination and performance. Medina Díaz says she was removed for refusing to sign.

Roig calls the allegations false and told Medina Díaz to swear to them. She says no contract was ever signed, and the department says it cancelled the process on Tuesday, 19 May 2026.

Roig acknowledged a draft after first denying it, and a letter of 20 January 2026 told NOLA Education its proposal was selected. The Senate Family committee and Justice are testing these facts, and none is a finding of wrongdoing.

Status of the Closed San Juan Childcare Center

NotiCel reports that the Familia department ordered the Arcoíris de Esperanza childcare center in San Juan closed on Tuesday, 20 October 2026. The order followed a Friday, 9 October inspection by the licensing office and the safety unit of ACUDEN, the child care agency.

The department listed exposure of children to strangers, weak supervision, toxic materials near play areas and staffing and paperwork gaps. It cancelled the licence under Law 173 of 2016 and ordered the children moved out safely.

No source checked links this closure to the contract investigation. Both reached the news on the same day, but the closure is a licensing action and the probe concerns an education contract.

The department’s statement does not say how many children were enrolled, who owns the center or whether it can appeal. Those details, and any reopening, are not yet public.

What It Means for You

Puerto Rico is a US territory and TANF is a federal program, so how its money is spent can draw federal attention. Rivera Schatz has said federal investigators are also involved, but no agency has confirmed that.

Travellers and investors face no direct effect from the probe. The case is a test of how the island oversees spending of federal aid money.

What Is Not Known

It is not known whether the prosecutors will find enough to recommend a special prosecutor, and no one has been charged. It is also not known when the 90 days officially began or whether Justice will seek an extension.

No source checked shows a federal investigation, and the claim that federal agents are involved rests on one senator’s statement. Roig has not been accused in court, and a Senate committee has not published findings.

Frequently Asked Questions

Is Suzanne Roig being charged with a crime?

Justice opened a preliminary investigation, which it says does not mean a crime was committed. Roig denies the allegations.

How long does the Justice Department have?

Ninety days to finish the preliminary investigation. The Panel on the Independent Special Prosecutor can grant up to 90 more days.

What is an independent special prosecutor in Puerto Rico?

A prosecutor appointed by the Panel, outside the Justice Department, to investigate and prosecute officials covered by Act 2 of 1988. Only the Panel can appoint one.

Can Roig keep her job during the investigation?

Yes. The law does not remove an official when a preliminary investigation opens, and no source checked reports a resignation or dismissal.

Is the closed San Juan childcare center part of the investigation?

No source links them. The center’s closure was announced on 20 October after a safety inspection, while the probe concerns a US$38.5 million education contract.
