Brazil: Justice Moraes says charges against those arrested for January 8 acts will be individualized

The Justice Alexandre de Moraes of the Federal Supreme Court (STF) said on Thursday (9), during the Court session, that the charges against each prisoner for the January 8 vandalism acts will be individualized.

According to him, custody hearings have been held, provisional releases have been analyzed, and summonses have been sent for the defendants’ prior defense.

The Justice’s statement was given in light of criticism of the STF about the alleged analysis of conduct in a general way in the investigations.

“The STF is analyzing in a detailed and individualized way so that, quickly, those who committed crimes will be held accountable under the law. Those who committed a lighter crime will have a lighter sanction, and those who committed a more serious crime will have a more serious sanction,” he said.

According to the Justice, the volume of work has “overloaded” the Supreme Court.

Still, the Court has met the legal deadlines “without any hassle and with absolute tranquility.”

MORAES SAYS THAT PRISONERS DO NOT WANT TO BE TRANSFERRED TO THEIR STATES

For the minister, the STF has fulfilled the procedure law provides in treating prisoners.

He reported the visit to the women’s prison last Monday (6), accompanied by Justice Rosa Weber and the acting governor of the Federal District, Celina Leão.

According to him, the inmates do not want to be transferred to their states, as some parliamentarians reported.

“I asked all the prisoners this question, and there was a unanimous response. There was no divergence; they all want to stay here,” he said.

The minister also informed that some lawyers hired by the arrested suspects no longer handle the defense of those involved.

“They only did the custody hearing and did not return,” he said.

Moraes also informed that part of the prisoners refused to accept the work of public defenders in their cases.

BALANCE OF THE ACTION

In the Court session, Moraes assessed the progress of investigations.

According to the Justice, among the 1,400 arrested after the acts of vandalism, 520 men and 82 women are still in custody.

The others are free and serve preventive measures, such as monitoring by electronic anklet.

According to the minister, 919 charges have been filed by the Prosecutor General’s Office (PGR) against those under investigation.

Of the total, 700 charges involve the conduct of incitement to crime, incitement of the Armed Forces against democratic institutions and criminal association, and 219 are about the crimes of aggravated damage, abolition of the Democratic State of Law, and coup d’état.
