Moraes’ vote was seconded by his colleagues Antonio Dias Toffoli, Edson Fachin, Cármen Lúcia, Rosa Weber and Gilmar Mendes.

Justice André Mendonça voted against the process, arguing that the STF does not have the competence to do so, which is the responsibility of the ordinary courts of first instance.

The Attorney General’s Office has denounced 1,390 people related to the January 8 attacks, which will continue on May 9 with the fourth set of accusations against another 250 people.

These individuals are charged with the alleged crimes of unlawful association, undermining the rule of law and the public and historical heritage, among others.
