Bolsonaro’s Lawyers Challenge Eight-Year Ban by Electoral Court

The legal team of former Brazilian President Jair Bolsonaro has appealed the decision by the Superior Electoral Tribunal (TSE) to potentially disqualify him for eight years over allegations of abuse of power and misuse of public resources.

Bolsonaro’s defense argued that the draft of a presidential decree, allegedly intended to influence the 2022 elections, which was found in the residence of Brasilia’s former Security Secretary, Anderson Torres, should not have been included in the case.

Torres had been detained for about a month on charges related to alleged misconduct during events on January 8.

Furthermore, Bolsonaro’s lawyers have claimed that the former president was not granted full rights to defense, asserting that procedural matters he raised during the trial were not properly addressed.

In this regard, the defense has filed clarification appeals, which are meant to question unclear or contradictory aspects of the case, as reported by the Brazilian news outlet G1.

The defense may escalate the matter to the Supreme Court by filing an “extraordinary appeal” to challenge aspects of the TSE’s decision they believe infringe upon the Constitution.

If the disqualification stands, Bolsonaro will be ineligible to run for political office until 2030.

The lawsuit was filed by the Democratic Labor Party (PDT) in August 2022, citing Bolsonaro’s critical remarks about the Brazilian electoral system, electronic ballot boxes, and the actions of the Supreme Federal Court (STF) and TSE during a meeting with ambassadors at the Alvorada Palace in July of that year.
