Bolsonaro Faces Serious Allegations as Court Upholds Moraes’ Role in Inquiry

The Brazilian Supreme Court has reached a decisive majority in a significant ruling concerning former President Jair Bolsonaro.

On December 6, 2024, the court denied a motion from Bolsonaro’s legal team, which sought to remove Justice Alexandre de Moraes from overseeing an investigation into an alleged coup attempt in 2022.

This investigation focuses on events that transpired during Bolsonaro’s presidency. Specifically, it examines efforts to obstruct the inauguration of Luiz Inácio Lula da Silva.

Bolsonaro’s defense argued that Moraes should recuse himself due to a potential conflict of interest. They claimed that Moraes was “part or directly interested” in the case.

However, the court’s president, Justice Luís Roberto Barroso, who is also the case’s rapporteur, dismissed these claims. He stated that the mere assertion of Moraes being a victim does not automatically disqualify him from leading the inquiry.

Barroso emphasized that the crimes under investigation—violent abolition of democratic order and attempted coup—impact the entire society rather than any individual victim.

Brazil’s Coup Investigation

The court’s virtual session commenced on this day, with electronic voting scheduled to continue until December 13. By mid-afternoon, a majority had formed against Bolsonaro’s appeal, with six justices voting to uphold Moraes’ role.

Justices Edson Fachin, Flávio Dino, Gilmar Mendes, Cristiano Zanin, and Dias Toffoli supported Barroso’s position. Moraes himself abstained from voting due to his involvement in the case.

This inquiry, often referred to as the “coup investigation,” scrutinizes alleged plans to undermine Brazil‘s democratic processes at the end of 2022.

Bolsonaro and 36 others face serious allegations related to this plot. These include accusations of organizing a criminal conspiracy aimed at assassinating Lula and other key figures, such as Vice President Geraldo Alckmin and Justice Moraes.

As the investigation proceeds, it has been forwarded to the Attorney General’s Office for further action—either pursuing formal charges or additional inquiries.
