How to Prove Financial Support with Form I-134 for Visa Applicants

What is Form I-134?

Form I-134, Declaration of Financial Support, is used to prove to USCIS that the petitioned K-1 fiancé(e) has sufficient financial support to pay for the cost of life in the U.S. during the temporary stay period. It must be completed by the U.S. citizen sponsor on behalf of their foreign-born fiancé(e).

How to Prepare Form I-134 in Support of a K-1 Visa Application

When it comes to preparing Form I-134 in support of a K-1 visa application, follow these steps:

  1. Download the most recent version of the form.
  2. The U.S. citizen petitioner must meet the required annual income according to the I-864P, HHS Poverty Guidelines for their household size and geographic location. For example, if the petitioner and fiancé(e) live together in one of the 48 contiguous states, they would need to meet the income requirement for a household of two in their geographic location.
  3. Fill out all the required information and attach all required documents proving the sponsor’s U.S. citizenship, employment, and financial information to sponsor the petitioned fiancé. Some of the documents that the U.S. citizen petitioner can present are:
    • A copy of the most recent federal tax return (all pages)
    • All W-2 and/or 1099 forms for the most recent tax year
    • Letter of employment from the petitioner’s employer written on business letterhead including their annual pay or hourly salary, number of hours worked per week, job title, and the date they were hired.

Difference Between I-864 and I-134

Form I-134 is used to prove that the sponsor will be financially responsible for the petitioned K-1 fiancé(e) during their stay in the U.S. until they get married, which must occur within the first 90 days of their entry into the country.

In contrast, Form I-864, Affidavit of Support, makes the sponsor financially responsible for the petitioned spouse during the time in which they are applying for a Green Card to permanently live in the U.S.
