Brazil: Supreme Court forms majority to make January 8 protesters defendants

On the night of Wednesday 19, the Brazilian Federal Supreme Court (STF) formed a majority to make defendants 100 protesters indicted by the Prosecutor General’s Office (PGR) due to the protests held on January 8.

During the act, the headquarters of the Three Branches of Power were vandalized.

The current score in the STF vote is 6 to 0.

Justices Luís Roberto Barroso, Gilmar Mendes, Dias Toffoli, Edson Fachin, and Cármen Lúcia followed Alexandre de Moraes’ lead.

Four Justices are yet to present their votes in the STF electronic system until Monday 24: André Mendonça, Nunes Marques, Rosa Weber, and Luiz Fux.

Appeals can still be filed against the receipt of the charges.

Following this, criminal proceedings will be opened, with new evidence being collected, witness statements being taken, and the January 8 defendants being questioned.

There is no deadline for the conclusion of the trials.

The defendants will answer for crimes such as:

  • Armed criminal association;
  • Violent abolition of the Democratic State of Law;
  • Coup d’etat;
  • Damage qualified by violence and serious threat with the use of a flammable substance against the inheritance of the Union and with considerable damage to the victim;
  • Deterioration of a heritage site.
