Gambling in Brazil
The prohibition of gambling in Brazil is governed by the Brazilian Criminal Misdemeanour Act. Its original purpose was to preserve social morality and Article 50 outlines punishments of fines or imprisonment for those who perform or establish the act of gambling.
Brazil’s federal lottery is operated by the Caixa Econômica Federal, the state-owned federal savings bank who have had a monopoly on lottery operations in the country since 1967.
There have been many parliamentary debates regarding betting regulations in Brazil ever since, with the main opposition coming from religious and ideological ideas.
Those behind moves for regulatory change argue that legislation would allow for greater control and would result in increased revenue through taxation.
A deal was finally agreed that would legalize gambling in Brazil, with January 1st, 2025 set as the launch date.
Changes to Brazilian Gambling Regulations for 2025
The Secretariat of Prizes and Betting (SPA) is a body set up by Brazil’s Ministry of Finance that is responsible for regulating, monitoring, supervising, and authorizing fixed odds bets, lotteries and sweepstakes, and the distribution of prizes as a form of advertising.
It has set out a framework that will launch legal gambling in Brazil from the start of 2025.
Operators were permitted to apply for licenses for online gaming that would be permitted under the new terms.
Normative Ordinance 1,225 relates to the monitoring and inspection of betting operators to ensure they comply with regulations. These inspections can be carried out remotely or in person, with operators required to provide requested information within 10 days of notification.
Normative Ordinance 1,212 covers the allocation of funds with prize money that expires being gathered by Brazil’s National Treasury Single Account. Operators will be responsible for this with records being made available to the SPA for five years.
Operators will also be subject to a gross revenue tax of 12% and player winnings to a 15% tax on winnings over BRL2,824 ($547.25). Monthly inspection fees will also be collected which will vary depending on the operator.
Normative Ordinance 1,231 will ensure operators act diligently when developing betting systems and advertising their services. Operators will be required to promote responsible gambling and maintain good communication with customers.
The gambling-providing companies will also be responsible for ensuring nobody under the age of 18 can access their services, and celebrity or influencer advertising will be prohibited.
The SPA’s final ordinance (1,233) will give them the power to take the relevant action of any operator that does not adhere to the regulations.
Failure to follow the new gambling regulations may result in a termination of their license. Warnings will be issued for less serious cases and fines will vary between 0.1% and 20% of the operator’s previous year’s proceeds.
