Superior Court Judge’s Son Garners Support for Appointment to National Justice Council

RIO DE JANEIRO, BRAZIL – Mário Henrique Aguiar Goulart Ribeiro Nunes Maia, son of Judge Napoleão Nunes Maia of the Federal Superior Court (STJ), Brazil’s second-highest court, should rely on the support of a good number of political parties in his bid to fill a vacancy in the National Council of Justice (CNJ) for the next two years.

In addition to the Judge’s son, Janaína Penalva, an attorney and professor at the Federal University of Brasília (UNB), is also in the picture. She will be appointed by the PSOL bench. “Janaína sought us out based on this collective construction, reflecting on the role of the justice system, the CNJ’s corporativism, and the absence of participation by civil society,” said PSOL leader Sâmia Bomfim.

Mário Maia is an attorney, but on the OAB website, he does not feature as an affiliate of any law firm. He does not appear as an attorney in any lawsuit at the Federal Supreme Court (STF). In 2017, Maia was barred at the Superior Electoral Court, when he tried to enter the plenary session, halfway into the trial that discussed the potential annulment of the Dilma-Temer slate. Security guards pointed out that he was wearing informal attire and thus would not be allowed to enter. Mário Maia said he wanted to talk to his father.

In his profile on the Lattes platform, in which researchers, jurists, and scholars in general commonly list their résumés, there is information that Mário Maia graduated in Law, at the Farias Brito College, in a period of only three years, which is less than the typical five years in law courses in Brazil. There is also information that he worked as an attorney at Pacheco e Vasconcelos Law Firm.

The report tried to reach Mário Maia, but he was not located. The Chamber of Deputies did not provide the report with the attorney’s updated résumé, under the allegation that this data would only be available after 7 PM.

The one name vote for the position is scheduled for this Tuesday’s session, October 27th. Mário Maia is named a favorite for the post and should have the backing of the left-wing PT and even some conservative parties like the DEM and Republicanos.
