Brazil’s Military Court claims it can not process filing and denies request to arrest Moraes and Barroso

The Minister of the Superior Military Court (STM), Artur Vidigal, denied the continuation of the criminal representation of a lawyer who listed at least 17 requests, among them the arrest of the ministers of the STF Alexandre de Moraes and Luís Roberto Barroso.

The minister affirmed that the STM’s jurisdiction is for processing and filing military crimes and emphasized that the Military Superior Court is “absolutely incompetent to process and judge the defendants”.

The requests denied Tuesday (Dec. 20) were filed on Dec. 8 by former judge Wilson Issao Koressawa.

One of the requests was to verify whether President-elect Luiz Inácio Lula da Silva (PT) is alive.

In his decision, Vidigal considered the accusations by lawyer Wilson Ossao Koressawa “generic”.

The first request made by the lawyer is to determine whether or not Lula da Silva is alive and why there is a double acting as if it were him.

There are also requests for arrests, blocking of bank accounts, and seizure of the passports of Senator David Alcolumbre, Senate President Rodrigo Pacheco, and Moraes and Barroso.

The lawyer claimed that the request was because the 2022 elections were violated by these authorities, considering the non-compliance with constitutional and legal principles.

Koressawa alleged that the authorities took actions that harmed the election campaign of current president Jair Bolsonaro (PL), which culminated in Lula da Silva’s victory.

With regard to the senators, the lawyer alleged that they omitted to impede the processing of impeachment requests presented against ministers of the STF.

Koressawa filed a criminal complaint and a criminal complaint requesting the preventive detention of the minister of the Supreme Court (STF), Alexandre de Moraes, at the Superior Military Court (STM).
