Brazilian Justice Moraes bans roadblocks and invasion of public buildings across the country

Justice Alexandre de Moraes, of the Federal Supreme Court (STF), determined the prohibition of blocking public roads and highways throughout the national territory.

The decision complies with the petition of the Attorney General’s Office (AGU), forwarded on the night of Tuesday, 10, after identifying a new mobilization for protests against the result of the 2022 elections. have been calling for coup-like demonstrations”, such as the “Mega national demonstration – for the return of power”, scheduled to take place this Wednesday, 11th, in all the capitals of the country, starting at 6 pm.

According to the AGU, the calls have been circulating in social media groups, especially Telegram, and the country is “on the verge of entering a serious situation” after the events of last Sunday, 8, when vandals broke the blockade that isolated the Esplanade of Ministries, in Brasília, and invaded the headquarters of the Three Powers – National Congress, the Planalto Palace and the Supreme Court -, causing the destruction of public assets and the historical heritage of the Presidency.

“The world, appalled, watched the attempt to completely destroy material and immaterial heritage, in addition to all the symbolism that democratic institutions carry. These resisted and strengthened. The patrimony will be repaired, unfortunately, at the expense of the entire treasury”, says an excerpt from the petition, which cites the new ongoing mobilization as a “new attempt to threaten the democratic rule of law”.

“Faced with the imminence of being found throughout the national territory yet another abusive scenario of the exercise of the right of assembly and a real attack on the Democratic State of Law”, continues the AGU, when asking that a series of measures be taken to curb new blockades and invasions, including the application of an hourly fine and determination of arrest in flagrante delicto – which was complied with by Justice Moraes.

The magistrate determines the prohibition of roadblocks across the country or invasions that interrupt traffic in buildings and public spaces, subject to a fine of R$20,000 for individuals and R$100,000 for legal entities that fail to comply with the prohibition through of direct participation in acts considered “anti-democratic”, as well as incitement – including electronically – or provision of material, logistical or financial support for blockades.

In the order, Justice Alexandre de Moraes provides that public authorities at all federative levels must adopt, under penalty of personal responsibility, the necessary measures to prevent attempts at blockades, executing the arrest in flagrante delicto of those who “occupy or obstruct urban roads and highways , including adjacent areas, as well as invade public buildings”.

The magistrate also requires the identification of all possible vehicles to be used in the practice of acts of obstruction, with qualification of the owners, and blocking of Telegram accounts and groups used to convene the acts.
