Lula’s administrative reform faces uncertainty amid offshore tax debate in Brazil

The potential setback in the vote on offshore capital taxation will not impede the administrative reform led by President Luiz Inácio Lula da Silva and Centrão leaders, a center-right party coalition, writes political outlet Poder360 in its latest report.

The taxation proposal was introduced as a means to compensate for the revenue loss caused by changes in the Income Tax exemption bracket for individuals.

If the proposal fails, the government will need an alternative to uphold Lula’s campaign promise, a task likely for Finance Minister Fernando Haddad.

The fate of offshore taxation remains uncertain.

Both Chamber of Deputies President Arthur Lira and Senate President Rodrigo Pacheco were initially opposed.

However, Pacheco later agreed to review the proposal, possibly rejecting it and suggesting its reintroduction as an executive bill.

The offshore capital tax was part of Provisional Measure No. 1,172 of 2023 concerning the minimum wage adjustment.

The measure is scheduled for a vote in the Chamber of Deputies next week.

Opposition is considering two actions: isolating the section on Income Tax or questioning its inclusion in the minimum wage adjustment measure, deeming it unrelated.

Constitutionally, the government cannot approve tax cuts without identifying compensatory revenue sources.

Thus, if offshore taxation is dropped, but other parts of the provisional measure are approved, the text may be deemed unconstitutional.

Another option under discussion, should the offshore taxation not be changed, is the revenue from online gambling taxation, governed by Provisional Measure 1,182/2023. However, funds from this source are already allocated for various purposes.

Lula’s administrative reform is tied to the expected passage of this tax package in Congress.

Any adjustments to the proposed measures will likely only be announced upon Lula’s return from his trip to South Africa, emphasizing the ongoing negotiation and collaboration between the executive and legislative branches.
