The Lula da Silva administration wants to force social networks to remove “crime against democracy and terrorism” content.
The PT suggested a deadline of two hours, the same one used in the 2022 election by the Superior Electoral Court.
What these crimes are will be determined by the government via the Supreme Court, and one can assume that primarily statements and narratives of the opposition, the conservatives, who are now called extreme right, are meant by this.
Conceived by the Minister of Justice, Flávio Dino, the proposals are being launched regardless of the existence of a definition in Brazilian law regarding the concepts of disinformation and fake news.
According to Dino, the proposal is contained in a provisional measure.
The text is expected to reach the National Congress in February, the newspaper O Estado de S. Paulo reported on Thursday 26.
At Lula’s request, the minister’s idea is to create “legal obligations” to the big techs that control social networks when there is committing “crimes against the democratic rule of law or terrorism” in virtual environments.
For Dino, the companies must be responsible for preventing the preparation and practice of crimes and removing content from the air following a court order.
In case of non-compliance, the minister suggests that digital platforms be fined. The amount of the fine was not informed.
