Prosecutor General says those involved in invasion in Brasília are not terrorists

The Prosecutor General’s Office (PGR) stated that the demonstrators who participated in the protest in Brasilia are not terrorists.

The position is contained in actions sent to the Federal Supreme Court (STF) by Carlos Santos, Deputy Prosecutor General of the Republic and coordinator of the Group to Combat Anti-Democratic Acts, reported the Metrópoles website, this Tuesday, 24.

In the process, Santos recalled that terrorism is only characterized in conduct taken for reasons of xenophobia, discrimination or prejudice based on race, color, ethnicity and religion.

The definition is contained in the Anti-Terrorism Law, nº 13.260/2016, approved by the National Congress.

“The commission of crimes, however serious they may be, for political reasons, is not part of the criminal categories”, noted Frederico.

According to the deputy prosecutor general, the decision does not reduce the seriousness of the facts, but respects the “fundamental guarantee provided for in article 5, item XXXIX, of the Constitution of the Republic”.

The device says that “there is no crime without a previous law that defines it, nor a penalty without prior legal commission”.

STF Justice Alexandre de Moraes ordered the arrest of the demonstrators, based on the Anti-Terrorism Law, as well as when he established the removal of the Governor of the Federal District, Ibaneis Rocha (MDB), and the arrest of the former Secretary of Public Security of the DF Anderson Torres.

In the decision, Moraes wrote that “there are strong indications of materiality and authorship of the crimes provided for in the Terrorism Law”.
