Brazil’s Attorney General appeals to Supreme Court over vaccine passport enforcement

RIO DE JANEIRO, BRAZIL – Federal Attorney General Bruno Bianco Leal has requested clarifications and corrections to what he considers “material errors” in Justice Luis Roberto Barroso’s decision, making the vaccine passport mandatory to enter Brazil, in an appeal lodged on Monday, December 13, at the Federal Supreme Court (STF).

The Attorney General considered in his request the “need to protect the right to citizenship of Brazilians and foreigners residing in Brazil who intend to return from abroad.”

In his opinion, exceptions must be made in items of the decision handed down on December 11. In order to comply with the provisions of the Brazilian Health Regulatory Agency (ANVISA), people lacking proof of vaccination should be allowed to enter Brazilian territory upon their consent to quarantine.

In addition, they can prove they have recovered from Covid-19 infection at least 11 days before, through documentation valid for up to 6 months, with technical requirements to be regulated by the federal government’s relevant bodies.

On December 11, Justice Luís Roberto Barroso ordered, in an injunction, the mandatory presentation of proof of vaccination for all travelers entering Brazil through airports and by land. The measure is currently in force.
