Brazilian Justice Lewandowski suspends 5 more actions of the corruption operation Lava Jato

Justice Ricardo Lewandowski of the Federal Supreme Court (STF) ordered the suspension of five criminal actions based on evidence obtained from documents and the whistleblowing of executives of Odebrecht, one of the contractors involved in the corruption scheme investigated by Operation Lava Jato.

The preliminary injunction decisions of Monday 13 benefit six defendants, including former Senator Edison Lobão, Minister of Mines and Energy in the government of Dilma Rousseff (PT).

Also benefited were the son and daughter-in-law of the former minister:

  • Márcio Lobão is a businessman, and former president of Brasilcap, the capitalization plans branch of Banco do Brasil,
  • and Marta Martins Fadel Lobão is a lawyer.

The other three defendants who had their actions preliminarily suspended by Lewandowski are:

  • Rodrigo Tacla Duran, a lawyer who worked for Odebrecht;
  • Othon Luiz Pinheiro da Silva, former president of Eletronuclear;
  • and businessman Jorge Theodocio Atherino da Silva.

Lewandowski’s new measures are extensions of a 2021 decision in which the Justice declared invalid the evidence obtained from the Odebrecht leniency agreement regarding President Lula.

In one of the investigations, Lula was accused of having received R$12 million in bribes from Odebrecht, an amount to be used to purchase land for the headquarters of the Lula Institute.

The charges against Lula in the Lava Jato investigation were based on the agreement and copies of the MyWebDayB and Drousys systems of the so-called Structured Operations Sector of Odebrecht, i.e., the bribery sector.

The Odebrecht spreadsheets had been tampered with.

In February, Lewandowski halted the last three criminal actions against Lula that originated in the Lava Jato, also for the same reason – that the evidence is invalid.

In another action, locked up last month by the STF, former Finance Minister Antonio Palocci and one of the directors of the Lula Institute, Paulo Okamotto, benefited.
