Appellate Court Overturns Injunction That Allowed Bars and Restaurants to Reopen

RIO DE JANEIRO, BRAZIL – The Minas Gerais Court of Appeals (TJMG) chief judge Gilson Soares Lemes, on Wednesday afternoon, July 22nd, ordered the lifting of the injunction granted in a collective writ of mandamus, brought by the ABRASEL (Brazilian Association of Bars and Restaurants) in Minas Gerais against the Mayor of Belo Horizonte, Alexandre Kalil’s decision.

The injunction authorized the reopening of restaurants and snack bars in the capital of Minas Gerais and was granted on Monday, July 20th, against the closure determined by municipal decree as a means to contain the spread of the Covid-19 pandemic in the capital of Minas Gerais. The injunction was appealed by the municipality, successfully arguing the need to contain the spread of the coronavirus in the city.

In his ruling, the TJMG’s chief judge Gilson Lemes stressed that the injunction is contrary to Resolution 17/2020, prepared by the Covid-19 Extraordinary Committee and also of the temporary restraining order granted in a Declaratory Action of Constitutionality (ADC) by Judge Marcia Milanez.

In addition, the chief judge noted, “the hostile decision does not fully meet the interests of the ABRASEL, as it has itself declared, and also seems inappropriate for the moment, considering the spread of the pandemic in the municipality.”
