RIO DE JANEIRO, BRAZIL – Former president of Brazil, Lula da Silva, is to be immediately released from prison this Friday, November 8th, after the Brazilian Supreme Court (STF) changed the rule approved in 2016 that allowed imprisonment after confirmation of the sentence by an appellate court.
This rule favors thousands of prisoners in this circumstance, the most famous of which is former President Lula da Silva.
By six votes in favor and five against, the STF overthrew on Thursday evening, the rule approved three years ago.
As a result, the previous understanding is once again in force, which is enshrined in the Constitution, that convicted individuals may only begin serving their sentences after it has become final, that is, after they have been exhausted all the appeals provided for by law.
